Susan has been practicing intellectual property law for over 27 years. Her practice focuses on the procurement and enforcement of all types of intellectual property, including: counseling and opinions with respect to validity and infringement of patents, trademarks, industrial designs and trade-secrets; trademark opposition and expungement proceedings; as well as the drafting and prosecution of patent, trademark and industrial design applications. As a litigator with considerable experience dealing with intellectual property disputes (including pharmaceutical patent litigation), Susan has been lead counsel on many reported decisions before the Federal Court and Federal Court of Appeal, many of which stand as significant precedents. She also appears before the Trademarks Opposition Board and the Patent Appeal Board. Finally, Susan has particular interest and experience with pharmaceutical regulatory and related administrative law.
Since 2008, Susan has taught patent infringement and validity as one of the instructors of the Patent Agent Training Course of the Intellectual Property Institute of Canada (IPIC). She has served two terms as a member of the Patent Agents Examination Board, which sets and administers professional licensing examinations for patent agents in Canada. Susan is a former Chair of the Intellectual Property National Section of the Canadian Bar Association and a past Executive Member of the CBA National Sections Council. From 2001 to 2011, she served as Chair of the CBA IP Court Practice Committee, with responsibility for organizing the CBA Federal Courts Judges’ Dinner. Currently, Susan is a member of the CBA Federal Courts Bench Bar Liaison Committee. Additional professional memberships include Intellectual Property Institute of Canada (Fellow), American Intellectual Property Law Association, American Bar Association, Canadian Healthcare Licensing Association, and Canadian Association for the Advancement of Science (President & Director).
Susan is an author and has been a speaker at numerous conferences; and also, for the past several years, a judge of the Canadian qualifying tournament for the Philip C. Jessup International Law Moot Court Competition. Having successfully completed training in both arbitration and mediation, Susan is available to serve as an ADR neutral for resolution of intellectual property and commercial disputes.
